Terms of Service

These Terms govern your access to and use of monsterhouse. By using the service or purchasing a plan, you agree to them. If you do not agree, do not use the service.
01The service
monsterhouse ("monsterhouse", "we", "us") provides software and a hosted service that watches livestreams, detects notable moments, reframes and captions them, and produces short-form clips. Plans differ in how compute is provisioned — from reserved attention time, to a dedicated operating instance, to a fully owned deployment — as described on our pricing page.
02Eligibility & accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of the information you provide, for any activity under your account, and for keeping your credentials secure. Notify us promptly of any unauthorised use.
03Acceptable use
You agree not to:
- Use the service to process content you do not have the right to use, or in violation of any third party's rights;
- Generate or publish content that is unlawful, infringing, defamatory, or that violates the rules of the platforms it is posted to;
- Attempt to disrupt, reverse-engineer, overload, or gain unauthorised access to the service or its infrastructure;
- Resell or sublicense the service except as expressly permitted in writing.
04Your content & rights
You keep all rights to your content. As between you and us, you own the source streams you direct us to and the clips we generate from them. We do not claim ownership of your content.
You grant us a limited, non-exclusive license to ingest, process, transform, store, and — where you instruct us to — publish that content for the sole purpose of providing the service to you. monsterhouse is a tool: we are paid for the process of creating and handling publishing, not for owning your work.
You represent that you have all necessary rights, licenses, and permissions for the streams and material you submit, and for clips published on your behalf.
05Third-party platforms
The service interacts with third-party platforms such as Kick, Twitch, and YouTube. Your use of those platforms is governed by their own terms, and you are responsible for complying with them, including any rules about clipping, reuploading, and monetisation. We respond to valid takedown and DMCA notices and may remove content or suspend accounts in response to them.
06Plans, billing & refunds
- Reserved attention is sold as prepaid time; it is consumed as the service runs on your stream.
- Subscription plans (e.g. a dedicated operating instance) bill in advance on a recurring basis and renew automatically until cancelled. You may cancel at any time, effective at the end of the current billing period.
- Custom / owned deployments are governed by a separate written agreement.
Payments are processed by Stripe. Fees are exclusive of taxes unless stated. Except where required by law, payments are non-refundable; we may, at our discretion, issue credits for service failures. We may change pricing prospectively with reasonable notice.
07Beta & availability
The service is offered on an evolving basis and may include beta features. We aim for high availability but do not guarantee uninterrupted or error-free operation, and we may modify, suspend, or discontinue features. Clip detection and reframing are automated and may occasionally produce imperfect results.
08Intellectual property
The monsterhouse software, models, designs, and brand are owned by us and protected by law. These Terms grant you a limited right to use the service; they do not transfer any ownership of our intellectual property to you.
09Disclaimer of warranties
The service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will meet your requirements or be uninterrupted, secure, or error-free.
10Limitation of liability
To the maximum extent permitted by law, monsterhouse will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim arising out of or relating to the service will not exceed the amount you paid us in the three (3) months preceding the event giving rise to the claim.
11Indemnification
You agree to indemnify and hold monsterhouse harmless from any claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the service, or your violation of these Terms or of any third party's rights.
12Termination
You may stop using the service at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or use the service in a way that creates risk or legal exposure. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
13Governing law
These Terms are governed by the laws of [the jurisdiction of monsterhouse's principal place of business], without regard to its conflict-of-laws rules, and the courts located there will have exclusive jurisdiction over any dispute, except where applicable consumer-protection law provides otherwise.
14Changes to these Terms
We may update these Terms from time to time. We will revise the "Last updated" date above and, for material changes, provide more prominent notice. Continued use of the service after changes take effect means you accept the updated Terms.
